INDIO, Calif (Reuters) - Award-winning actor Robert Downey Jr. (news - web sites) entered a not guilty plea on Thursday on drug possession charges, and prosecutors said they were discussing a plea bargain that could avoid Downey returning to prison.

Downey's brief court appearance was the first time that the ''Ally McBeal (news - Y! TV)'' star has been seen in public since he checked himself into a rehabilitation center in April following his arrest in a suburban Los Angeles alley on suspicion of being under the influence of cocaine.

The 36-year-old actor, looking fit and smartly dressed in a dark blue suit, white shirt and tie, did not speak in court.

His lawyers said he would plead not guilty to charges stemming from last November of misdemeanor possession of the prescription drug Valium and felony possession of cocaine.

Downey's November arrest in a posh Palm Springs hotel came only four months after he was released from a one-year prison stay on a previous drug offense, and a new conviction could have resulted in another jail term.

Thursday's hearing was continued until July 16 at the request of defense lawyers. But speaking to reporters afterward, deputy district attorney Tammy Capone said discussions were under way with the defense on a plea bargain.

``We are getting really close,'' Capone said. Asked whether Downey's current six-month stay in a rehab center could satisfy the requirements of prosecutors she replied; ``Possibly, yes.''

Capone referred to Proposition 36 passed by California voters last November, which encourages mandatory treatment rather than jail for drug addicts with no history of violence. Prosecutors have already decided not to file criminal charges in Downey's April arrest.

One of Downey's Drug Charges Changed

INDIO, Calif. (AP) - Prosecutors have reduced one of the charges in Robert Downey Jr.'s Palm Springs drug possession case to a misdemeanor.

Downey was scheduled to be arraigned Thursday in a Riverside County court on the reduced charge after his attorneys filed a court document arguing he should be charged with a misdemeanor for allegedly possessing Valium, Deputy District Attorney Tamara Capone said.

However, Downey still faces a felony count of possessing cocaine and an additional misdemeanor count of being under the influence of a controlled substance, she said.

The 36-year-old former ``Ally McBeal '' co-star was arrested at Merv Griffin's Resort Hotel and Givenchy Spa last November. Authorities allegedly found the drugs in his hotel room after receiving an anonymous 911 call.

The actor's legal troubles began in 1996 when he was stopped for speeding and authorities found cocaine, heroin and a pistol in his vehicle.

A month later he was found passed out in a neighbor's home and was hospitalized at a substance-abuse treatment center. Three days later, he was arrested for leaving the center.

In August 1999, Downey was sentenced to three years in prison for violating his probation by missing scheduled drug tests. He was released a year later on $5,000 bail.

Downey was arrested in a Culver City alley last month and was booked for investigation of being under the influence of drugs. Prosecutors have said that arrest will be handled as a parole violation.

PALM SPRINGS, Calif. (Reuters) - Lawyers for Robert Downey Jr. told a judge on Thursday that they cannot reach a plea agreement with prosecutors on drug possession charges against the troubled actor and he now faces a trial in which he could go to jail for almost five years if convicted.

Superior Court Judge B.J. Bjork set a preliminary hearing date for April 30 at which the actor must appear.

He was not in court on Thursday for the brief hearing stemming from his arrest at a posh Palm Springs resort hotel last November when police allegedly found cocaine and the prescription drug Valium in his room.

The arrest came just three months after his release from prison after serving a year in jail for previous drug charges.

Outside the court, Downey's lawyer Daniel Brookman indicated to reporters that efforts to reach a plea bargain failed on the question of whether Downing, who has successfully rebuilt his acting career, should be returned to jail.

Brookman said prosecutors ``have made an offer that does call for some sort of restraint on Mr. Downey's freedom.''
